Article 1

Introductory Provisions

1. The Defense Planning Committee (hereinafter as “Committee”) is a standing working body of the National Security Council (hereinafter as "NSC"), which is responsible for the coordination and planning of measures for the defense of the Czech Republic (hereinafter as "CR").

2. The Committee was established under Resolution of the Government of the Czech Republic No. 391 of 10 June 1998

Article 2

Activities of the Committee

1. As part of its activities, the Committee evaluates and reviews the following:

- The ideas for planning and preparatory activities in the area of defense of the CR, as presented by governmental bodies, ministries and other administrative offices.

- The overall requirements of governmental bodies, ministries and other administrative offices, as put into place as part of defense planning and with a focus on defense planning.

- The strategic and conceptual proposals of governmental bodies, ministries and other administrative offices in the area of defense planning.

- Materials based on resolutions passed by the NSC.

2. The Committee works on the basis of the NSC's Work Plan.

Article 3

Makeup of the Committee

1. The Committee has 14 members.

2. The Minister of Defense is the Chairperson of the Committee. The First Deputy of the Minister of Defense is the Executive Vice-Chairperson of the Committee.

3. Other members of the Committee are:

a) Deputy Minister of Foreign Affairs

b) Deputy Minister of Agriculture

c) Deputy Minister of Interior

d) Deputy Minister of Finance

e) Deputy Minister of Industry and Trade

f) Deputy Minister of Transportation

g) Deputy Minister of Labor and Social Affairs

h) Deputy Minister of Health

i) Chairperson of the Administration of State Material Reserves

j) Vice-Governor of the Czech National Bank

k) Director of the Secretariat of the National Security Council (hereinafter as “Director of the Secretariat of the NSC")

l) Chairperson of the Council of the Czech Telecommunication Office (hereinafter as “Chairperson of the Council of the CTO")

4. The executive vice-chairperson of the Committee is appointed and removed from the position by the Minister of Defense. The members of the Committee are appointed and removed by the respective ministers and the Governor of the Czech National Bank.

5. To establish their permanent representation, the respective ministers, the Chairperson of the Administration of State Material Reserves, the Governor of the Czech National Bank, the Director of the Secretariat of the NSC and the Chairperson of the Council of the CTO shall appoint an alternate member of the Committee for each respective existing member.

6. The alternate member of the Committee attends the meetings of the Committee if the respective Committee member is absent, while exercising all of the rights and attending to all of the obligations of the respective Committee member.

7. In exceptional situations in which neither the respective committee member nor their alternate can attend a meeting, the respective authority may appoint another representative to participate in the respective meeting. However, such a representative must be able to verify the status of their appointment by the respective minister, the Chairperson of the Administration of State Material Reserves, the Governor of the Czech National Bank, the Director of the Secretariat of the NSC or the Chairperson of the Council of the CTO. Unless this criterion has been met, the respective authority shall have to forgo representation at the respective meeting.

8. Changes to the makeup of the Committee (both Committee members or alternates) are reported in writing to the chairperson of the Committee by the respective authorities. The changes are recorded and archived by the secretariat of the Committee, which provides regular updates on any such changes at Committee meetings.

Article 4

Secretariat of the Committee

1. The administrative activities of the Committee are handled by the secretariat of the Committee. The designated unit of the Ministry of Defense does the work of the secretariat of the Committee.

Article 5

External Cooperation

1. To ensure a maximum degree of coordination and professional assessment of the materials being reviewed by the Committee, the Committee's meetings are also regularly attended by a representative of the Security Information Service, the Chief of the General Staff of the Army of the CR and the Security Director of the Ministry of Defense.

2. As required, the Committee may invite to its meetings representatives of various governmental bodies, ministries and other administrative offices that are not members of the Committee as well as inviting to such meetings other experts. Decisions regarding invitations to such meetings are made by the chairperson of the Committee.

Article 6

Rights and Obligations of Committee Members

1. The chairperson of the Committee has all of the rights of a Committee member, as well as the following additional rights:

- The right to schedule a regular or a special Committee meeting.

- The right to monitor follow-up to resolutions passed by the Committee.

2. A Committee member has the following specific rights:

- To request that the respective governmental bodies, ministries and other administrative offices provide any necessary materials or information that relate to the subject matter to be discussed at a meeting and to consult and discuss the contents of these materials with the respective officials.

- To ask questions of other members of the Committee, temporary interdepartmental work groups and any other parties invited to attend the respective Committee meeting.

- To present proposals for the refinement or modification of materials being presented.

- To request the scheduling of a Committee meeting or to request that certain urgent matters or verbal information be added to the agenda of a Committee meeting as items to be discussed.

- If the member is unable to participate in a Committee meeting for serious reasons, the member may communicate his or her comments on the materials to be discussed to the chairperson of the Committee or present these comments at the Committee meeting through a designated employee, representing the respective authority. The principles behind such representation are governed by Article 3 of the Committee's Statutes.

- To make suggestions for the Committee's Work Plan for the respective calendar year.

3. Both the chairperson and members of the Committee have the following specific responsibilities:

- To adhere to resolutions passed by the Committee.

- To personally attend the meetings of the Committee. If the person cannot attend a meeting for serious reasons, that person may be represented by a representative designated in accordance with Article 3 of the Committee's Statutes.

- To study and (depending on their level of authority) to evaluate the materials being presented at the respective meeting of the Committee and, as necessary, to give their input on the materials being discussed and to provide their opinion.

4. A member of the Committee has the following specific responsibilities:

- To inform (report) to their superior about the outcome of the respective meeting of the Committee.

Article 7

Temporary Interdepartmental Work Groups

1. To look into any particular subject issues, the Committee may set up – using members of the Committee, the representatives of the respective governmental bodies, ministries and other administrative offices and invited experts – temporary interdepartmental work groups and appoint the heads of such work groups.

2. The heads of the temporary interdepartmental work groups and working bodies of experts oversee the meetings of these work groups and submit the materials prepared by the respective work group to be reviewed at the meetings of the Committee.

Article 8

Procedural Rules

1. The meetings of the Committee and the methods to be used for the preparation and submission of the respective materials are subject to the Committee's Procedural Rules. The Committee's Procedural Rules and any changes or amendments thereto are subject to approval by the NSC.

2. Meetings of temporary interdepartmental work groups are governed by the respective Procedural Rules of such bodies or, if applicable, by the Committee's Procedural Rules.

Article 9

Final Provisions

1. Changes and amendments to the Statutes of the Defense Planning Committee are subject to being approved by the government.

2. These Statutes are available to the public on the internet website of the Office of the Government and at the seat of the Office of the Government. The complete version of the Statutes is posted on the website.

3. These Statutes come into effect on the date of their approval.
